The importance of a patent

If you go into Google and into the Google News section and type in the word patent into the search box, you will find a myriad of news stories about patent infringement lawsuits. Most of the cases get settled out of court. And most are focused on technology products. This post will go through some of the most recent ones and give some details about each case.

The touch screen debate: Microsoft, Apple, LG and several others have been sued by a company called Tsera. Tsera has said that the companies have violated their patent on touch screens. The touch screen is the new hot thing in cell phones and MP3 players, even cameras. When a person thinks touch screen, probably thinks of the I Phone first. But Tsera is saying that the technology is theirs.  The patent that Tsera has says how a user would generally use a touch screen, by moving their fingers on the touch screen or touch pad surface.  The suit claims infringement back from 2004. Tsera does not operate a website or any means to gain more information about them. The suit was filed in East Texas and is awaiting a hearing.

Plavix debate: Plavix is a drug that is marketed by the Bristol-Myers Squibb Co. The drug is supposed to prevent blood platelets from sticking together so heart attacks in certain individuals can be avoided. They just settled a lawsuit for $125 million because of a patent battle surrounding the drug.  The company pleaded guilty to criminal charges due to lying about the patent.

The Importance of Knowing Your Customer

Businesses involved in import and export transactions are bound by the regulations of the Export Administration(EAR).  These regulations state that it is illegal not to know your customer.  Meaning that the products shipped or received must be clearly defined in terms of the end use of the items.  Items exported that are intended for use in the destination country for purposes relating to biological, chemical, or nuclear weapons or anything else related to weapons and missiles are strictly regulated, and require valid licenses.  It is illegal to turn a blind eye, companies must do everything they possibly can to know those they are doing business with and to report any abnormal or suspicious circumstances surrounding the transactions.

These circumstances or suspicions are termed “red flags”.  One such give away, is when a company places an order for items that are not congruent with the needs of the business.  Another red flag is when the company declines installation of a product or the testing of that product when that service is provided in the total cost of the order or purchase or when the order placed is incompatible for the given destination, such as in voltage of electricity; when a country’s standard volts is 220 but they order products of 120 volts.

If one does not notice any red flags, and if the information the company receives is valid, then one may proceed with business transactions.  The company is not required to further verify, inquire or investigate when there are no initial red flags, however if there are the company has the duty to investigate.  They must dig deeper in the attempt to define the end use of the products they are about to export.  Documents are required to be obtained, and any concealment or misrepresentation of the facts is illegal.  Some companies may react in turning a blind eye to the red flags, a kind of ‘don’t ask don’t tell’ mentality.  This is very dangerous.  Sales teams must question potential clients as to the exact use of their products.  Companies will still be held liable in the end, should their products be used at the end destination for the above mentioned purposes of weapons and/or missile production.  Be aware, always know your customer.

Research to Further Distinction of Teaching Methods of Boys vs. Girls

Researchers in child psychology, biology and education have agreed for a long time, that boys and girls have different abilities in the area of language and communication.  The University of Haifa, and the Chicago Northwestern University have produced findings that are unambiguous.  Both studies show that the sections of the brain that is connected with language differ dramatically, working harder in girls than those sections of the brain in boys.  And when the two genders are performing those language tasks, that different sections of the brain are at work.  The researchers used MRI machines to measure the activity in the brains of thirty one girls, and thirty one boys as they performed tasks of writing and spelling.  The children ranged in age from nine to fifteen.  What they found that girls respond in ways that are more abstract, and that the boys were more sensory motivated.  In this way, researchers, administrators and teachers are looking to find how better to attend to the differences in the Northumberland boarding schools, the private schools and the public schools throughout the country and the rest of the world.

Testing and teaching methods could change, will change.   Some of the differences which appear in children as far as the way one processes written and spoken word, do perhaps change by the time one reaches adulthood.  However, the learning process along the way, determines the kind of adulthood one grows into, and so the methods for classroom learning must address this.   As far as testing goes, the girls and their abstract ways of hearing and seeing and learning, suggest that standard testing methods for now, are sufficient.  For boys however, the researchers suggest that when testing boys on the lectures and written subjects it would be beneficial for them to be questioned orally.  This would make up for the auditory or visual hold up in the way in which they process information.  This is not to be seen as a deficiency, as in the days of evolution, for those in the primitive world, it was necessary for survival to notice signs of danger based on the sounds and the sights surrounding them.  It is a good adaption, and one that can be addressed in the modern world, in the contemporary classrooms.

Take a weird vacation

The vacation you thought you were going to take this summer did not quite pan out. There is this thing called the economy that keeps getting in the way and always ruining your plans! Boo, economy. Okay okay, there is no need to fret, so maybe your dreams of an exotic locale on the world map are out of the question, but the good old United States of America has many interesting places that are reachable, gasp, by automobile. So gas up your car and get going, it’s time to take a weird vacation!

Check a road map to find out where there are some interesting landmarks are not far from your hometown. There are bound to be some. Heck, there are entire blogs dedicated to weird American landmarks. They are quirky and fun and man they are sure conversation starters.

A good place to check for some near you in online, just type in your state plus weird landmarks. The results will probably surprise you. For example, I typed in weird landmarks plus Arizona and came up with some results that would interest any road traveler. There are lots of haunted places in Arizona, including one in Jerome that is a short drive from Phoenix. And there is always a trip to famous and classic Tombstone, an Arizona icon, near Tucson.

Road trips are a great way to explore the unique American landscape and meet some cool people on the way. The travel time is a lot better because you aren’t stuck in layovers in the airport while you are making your way across the world globe for that expensive vacation.

Road trips are great; you can do them on a whim and visit some weird landmarks. So gather some friends together and go have yourself a little adventure.
